Terms of Service
These terms apply when you use this website or buy from us. By placing an order you accept them. Please read them before you order.
In these terms, "we", "us" and "our" means Cards by Jennie, ABN 91 137 310 537.
1. Using this site
You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. You agree not to use the site for anything unlawful, and not to interfere with its operation or security.
2. Product information
We photograph and describe our cards as accurately as we can. Colours can vary slightly between screens, and printed colour will not always match what you see on your monitor exactly. Card dimensions are approximate and given as folded size.
3. Orders
Your order is an offer to buy. A contract is formed only when we send you a dispatch confirmation. Until then we may decline or cancel an order, including where:
- The item is out of stock
- There has been a pricing or description error
- We are unable to verify payment
- We reasonably suspect fraud
If we cancel an order you have already paid for, we will refund you in full.
4. Prices and GST
All prices are in Australian dollars and include GST. Delivery charges are shown at checkout before you pay.
We may change prices at any time, but changes will not affect orders we have already accepted. If a product is listed at an obviously incorrect price, we are not obliged to supply it at that price and will contact you before doing anything else.
5. Payment
Payment is taken in full at checkout. We accept various payment methods. Payments are processed by third-party providers under their own terms.
6. Delivery
Delivery is covered in our Shipping Policy. Delivery timeframes are estimates provided by our carriers, not guarantees.
7. Returns and your rights as a consumer
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Full details are in our Returns and Refunds Policy. Nothing in these terms limits your rights under that law.
8. Intellectual property
Every photograph, design, illustration and piece of written content on this site is original work owned by Cards by Jennie or used under licence. It is protected by copyright.
When you buy a card, you are buying the physical card. You are not buying any rights in the photograph or design on it.
You may not, without our written permission:
- Reproduce, scan, photograph or digitise our cards or images
- Use our images in any product, publication, advertising or online content
- Print, sell or distribute our designs, whether altered or not
- Use our images to train, fine tune or develop any machine learning or artificial intelligence system
You may share photos of our cards on social media, and we would be pleased if you did, as long as you do not present the artwork as your own and you credit us where you reasonably can.
9. Our liability
To the extent permitted by law, and except for the consumer guarantees referred to in clause 7, our liability to you is limited to replacing the goods or refunding the price you paid. We are not liable for indirect or consequential loss.
10. Links to other sites
We sometimes link to other websites. We do not control them and are not responsible for their content or their handling of your information.
11. Site availability
We aim to keep the site running, but we do not guarantee it will always be available or free of errors.
12. Privacy
Your information is handled in accordance with our Privacy Policy.
13. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of that state.
14. Changes to these terms
We may update these terms. The version on this page at the time you order is the version that applies to your order.
